Under the Family Law Act, a de-facto relationship exists if you and your former partner were living together. This applies to same-sex relationships as well. Various circumstances determine if parties were in a de-facto relationship, for example:

• The duration of the relationship
• Whether the parties lived in the same residence
• If there are children to the relationship
